It is a micro utility truck under Kansas law. It takes a nonhighway title, carries no plate and may use public roads other than interstate, federal and state highways once equipped, with city streets open where the city allows.

Where it can run

Farms, ranches and private land. Kansas law on its face also lets a micro utility truck use roads other than interstate, federal and state highways, but a governed truck is nonroad equipment under federal law and is offered here for private ground.

Title. Nonhighway certificate of title. The micro utility truck definition asks whether the truck could exceed 40 mph as originally manufactured, so on its face it reaches a governed truck as well as an old one.

Registration. None. K.S.A. 8-198(a). Kansas all-terrain vehicles are 55 inches or less wide and 1,500 pounds or less dry. Its work-site utility and recreational off-highway classes run on nonhighway tires, so a kei truck on its own tires fits none of them.

A newer truck comes in only as nonroad equipment, permanently governed to a top speed and with a nonroad engine certified by EPA before import. It pays the same 25 percent truck duty. What that engine needs.

Statewide

A kei truck is a micro utility truck in Kansas, a class of its own, and not an all-terrain vehicle, a work-site utility vehicle or a recreational off-highway vehicle, so the city acts for those machines do not name it unless they say micro utility truck. K.S.A. 8-126(a) makes an all-terrain vehicle a nonhighway vehicle 55 inches or less wide and 1,500 pounds or less dry on three or more nonhighway tires. Section 8-126(uu) makes a work-site utility vehicle one with four or more nonhighway tires and 8-126(ii) makes a recreational off-highway vehicle one on four or more nonhighway tires, and a kei truck rolls on road tires. Section 8-126(v) makes a micro utility truck any motor vehicle at least 48 inches wide, no more than 160 inches long, more than 1,500 pounds unladen with fuel and fluids, able to exceed 40 mph as originally manufactured and built with a metal cab, and it excludes the other two classes by name. A kei truck about 55 inches wide meets the width, the length and the metal cab, and the weight is the figure to measure because some trucks sit near the 1,500 pound line. The micro utility truck rule in 8-15,106(a) reads the same as the all-terrain rule in 8-15,100(a) and the work-site rule in 8-15,109(a). Each makes the machine unlawful on any interstate, federal or state highway and on the public streets inside a city unless the city authorizes it, and each lets it cross a federal or state highway. So the county and township roads outside the cities are open by the statute to a kei truck that carries the article 17 equipment and a nonhighway title, with no plate, and to a UTV of the work-site class. The difference is the city street. A city that authorizes UTVs by ordinance has not authorized a micro utility truck unless its ordinance names that class, and each city act below says which classes it names. A truck 25 years or older fits the definition. A newer truck governed to 25 mph also fits it on its face, because the test is the speed the truck could exceed as originally manufactured, which the state file reads as reaching a governed truck too, but federal law treats a governed truck as nonroad equipment and the state file offers it private ground first. EPA asks for a certified engine

A newer kei truck comes in as nonroad equipment, permanently modified so its top speed is 25 mph or less, with its engine covered by an EPA certificate of conformity before it reaches US Customs. The governor stays for the life of the truck, and removing it is tampering, a federal offense.

Engine size

Why 30 kilowatts decides a newer truck's engine

EPA sorts nonroad gasoline engines by maximum power, not size. Every kei engine is under 1,000 cc, so an engine of 30 kW or less may certify to the small engine standards, and 30 kW is the line that decides. Today's stock kei engines are rated above it, and a speed governor does not lower an engine's maximum power.

Every kei engine family EPA has certified for mini trucks is a lower power certified configuration, between 14.46 and 29.9 kW, under part 90 or part 1054. A certified mini truck engine is that configuration, not the stock engine.

TitleHow do I title and register it?

Kansas counts every micro utility truck as a nonhighway vehicle, so it carries a nonhighway certificate of title from the county treasurer and is not registered with plates.

The steps

Check the truck against the micro utility truck terms in K.S.A. 8-126(v), weight included: the class starts above 1,500 pounds unladen with fuel and fluids.
If the truck was last titled in another state, take it and that title to a Kansas Highway Patrol inspection station for a Motor Vehicle Examination (form MVE-1).
Apply at the treasurer's office in the county where you live for a nonhighway certificate of title, certifying on the application that the truck is a nonhighway vehicle. K.S.A. 8-198(c)
Where no certificate of title has ever been issued and the seller is not a vehicle dealer, the Division of Vehicles asks for a bill of sale or the owner's affidavit with at least one corroborating affidavit before it issues the nonhighway title. K.S.A. 8-198(b)(4)

On a farm, a ranch or other private ground a micro utility truck needs no Kansas registration. It keeps its nonhighway title when it changes hands.

Yes, on public roads that are not interstate, federal or state highways, such as county and township roads, once the truck carries the lighting and other equipment Kansas requires. It may cross a state or federal highway but may not drive along one. Inside city limits it needs the city's authorization.

Does it get license plates?

No. Kansas classes a micro utility truck as a nonhighway vehicle. It is titled with a nonhighway certificate of title and is not registered.

Which trucks count as micro utility trucks?

Upgrades

Upgrades in Kansas.

Height and lift. No bumper, frame or lift rule found. Headlamps must be mounted 24 to 54 inches high (8-1705). Overall height is capped at 14 feet including load (8-1904). Equipment law allows additional parts and accessories that are not inconsistent with the article (8-1701).

Tires and fenders. A tire is unsafe with tread under 1/16 inch in two adjacent grooves, exposed cord, a bulge or a not-for-highway marking (8-1742). No fender, tire size or wheel spacer rule found.

Lights. Up to two auxiliary driving lamps at 16 to 42 inches and two fog lamps at 12 to 30 (8-1719). No more than 4 front lamps lit at once (8-1728). Front light may be only white or amber (8-1729).

Modification and inspection. A vehicle materially altered by removing, adding or substituting essential parts is specially constructed (8-126). An assembled or reconstructed vehicle goes to the Highway Patrol for a check, with the history of its parts (8-116a). Officers may require an inspection on reasonable cause (8-1759a).
