Kei trucks in West Virginia, free on the farm and street legal on back roads
Read from West Virginia's own statutes and motor vehicle office.
West Virginia names the mini-truck in two laws. On the farm a kei truck needs no title or plate and may run between tracts of land up to 35 miles in daylight. Equipped, titled and registered it runs as a street-legal special purpose vehicle off interstates and federal-aid highways. That holds for a 25 year old truck imported for the road and for a newer truck imported as off road equipment and governed to 25 mph, which matches the farm definition word for word.
Your lane
Which truck are you buying?
West Virginia treats the two kinds of kei truck differently. Pick yours and this answers for it.
A kei truck 25 years or older is a mini-truck under West Virginia's special purpose vehicle law and runs on the road as a street-legal special purpose vehicle with that law's limits.
Road use with limitsTitle. Titled by the West Virginia Division of Motor Vehicles under the certificate of title provisions of Chapter 17A.
Registration. Registered in the same manner as a motorcycle, with a plate the size of a Class G motorcycle plate.
- No controlled-access or federal-aid highways and no more than 20 miles on roads with centerline markings
- The full street-legal equipment list in 17A-13-1(j)
- Counties, municipalities and the Division of Natural Resources may prohibit special purpose vehicles on their highways

Can I drive a 25 year old kei truck on West Virginia roads?
Yes, as a street-legal special purpose vehicle. It is titled, registered like a motorcycle and equipped with lights, signals, mirrors, a horn, a speedometer and good tires. It stays off controlled-access and federal-aid highways and runs no more than 20 miles on roads with centerline markings.
A newer kei truck imported as off road equipment fits West Virginia's farm definition of a mini-truck word for word: a foreign-manufactured import designed primarily for off-road use, 550cc to 660cc and about 1,800 pounds. Used for farming it needs no title or registration and may use highways between tracts of land. Equipped and registered, it may also run as a street-legal special purpose vehicle.
Farm useWhere it can run
Farms and private land; public highways other than expressways when going from one tract of land to another, up to 35 miles, in daylight; and as a registered street-legal special purpose vehicle on roads that law allows.
Title. None required for a mini-truck used exclusively for agricultural or horticultural purposes. A title is required for street-legal use.
Registration. Exempt from registration on the farm (17A-3-2(a)(2)(A)). For street-legal use it registers like a motorcycle under 17A-13-1.
- Farm mini-trucks may use the highways going from one tract of land to another, whether the land is owned by the same or different persons (17A-3-2(a)(2)(A))
- The distance between points may not exceed 35 miles and the route may not be an expressway (17A-3-2(a)(2))
- An exempt vehicle may not use the highways between sunset and sunrise unless it is a Class A farm-use vehicle with a current inspection sticker traveling 35 miles or less between tracts (17A-3-2(a)(2)(B))
- A street-legal mini-truck must meet the equipment list in 17A-13-1(j) and the road limits in 17A-13-1(c), (d) and (k)
A newer truck comes in only as nonroad equipment, permanently governed to a top speed and with a nonroad engine certified by EPA before import. It pays the same 25 percent truck duty. What that engine needs.
What about a newer truck imported as off road equipment and governed to 25 mph?
West Virginia's farm definition of a mini-truck is a foreign-manufactured import designed primarily for off-road use, 550cc to 660cc and about 1,800 pounds. Used for farming it needs no title or registration and may cross and use highways other than expressways between tracts of land up to 35 miles, in daylight. It may also be equipped and registered as a street-legal special purpose vehicle.
Private land and the farm
On your own ground in West Virginia.
On private land
On private land and on a farm off the public road a mini-truck is not on a highway and none of the county or town acts on this map applies. Title and registration are for street-legal use under 17A-13-1, and that section opens no area that is not open to motor vehicle use (17A-13-1(f)).
The codecode.wvlegislature.gov, read 28 October 2026On the farm
A mini-truck used exclusively for agricultural or horticultural purposes is exempt from title and registration and may use highways other than expressways to go from one tract of land to another, owned by the same person or different persons, up to 35 miles and by day. A farm exempt vehicle may not use the highways between sunset and sunrise unless it is a Class A farm-use vehicle with a current inspection sticker traveling 35 miles or less between tracts.

Statewide
A governed kei truck counts in West Virginia, because the mini-truck is named with the ATV and the UTV in the special purpose vehicle class of W. Va. Code 17A-13-1(b)(1), and a special purpose vehicle that is titled, registered like a motorcycle, insured and fitted with the lamps, signals, mirrors, horn, speedometer and tires 17A-13-1(j) lists may use a public road no one has closed to it. That is the state's own default and no county or town has to open a road first. The limits are the statute's: no controlled-access highway, no highway built under a federal highways program for a mini-truck, and no more than 20 miles on a highway with centerline pavement markings (17A-13-1(c), (d) and (k)). The closing power is local. 17A-13-1(c) lets the county, the municipality or the Division of Natural Resources prohibit special purpose vehicles on the highways it governs, and 17F-1-3 lets a municipality regulate or prohibit all-terrain vehicles on any street by ordinance and a county commission with a countywide comprehensive plan in effect do the same on any road except an interstate. Chapter 17F reads all-terrain vehicle in that article as including utility terrain vehicles and off-highway vehicles (17F-1-9(b)), but a kei truck imported for the road is not a straddle seat ATV, is not designed for off-highway use and is left out of the UTV definition in 17A-1-1, so an ordinance that names only ATVs does not on its face reach it. Whether a given act reaches a registered street-legal mini-truck is a question of that act's own words. On a farm a mini-truck used only for agricultural or horticultural purposes needs no title or registration and may use highways other than expressways to go from one tract of land to another, up to 35 miles and by day (17A-3-2(a)(2)(A)). A 25 year truck and a newer one governed to 25 mph both fit the farm definition and the road class, and the state file for West Virginia marks the road class restricted.
Barbour CountyRoads openNo county ordinance on ATVs, UTVs or special purpose vehicles was found for Barbour County. West Virginia's default opens its public roads to a titled, registered, insured and equipped kei truck as a mini-truck, off interstates and any highway built under a federal highways program and no more than 20 miles on a centerline road, so the county reads open. Its pageBerkeley CountyRoads openBerkeley County's 2004 order keeps straddle seat ATVs off every county road and county park, with a few towns able to opt in, and says nothing of a UTV or a truck, so a titled, registered and equipped kei truck keeps the state's default on county roads, up to 20 miles on a centerline road and off any highway built under a federal highways program. The commission's order under 17F-1-3 bars an ATV from any road, street or avenue in the county and from county property, parks included, except interstates and the streets of incorporated municipalities whose governing bodies have affirmatively provided for ATVs, with farm, oil and gas, timbering, surveying and utility use exempt, and it covers the roads of subdivisions that petition. It defines an ATV as a motor vehicle 52 inches or less wide, 800 pounds or less unladen, on three or more low pressure tires, with a seat designed to be straddled. A UTV, which has a steering wheel and bench or bucket seats, and a mini-truck are outside that definition, so the state's default for a street-legal special purpose vehicle stands on county roads. The commission recites a comprehensive plan under which the county operates. The copy read is a 2010 filing of the order with the subdivision list, which runs to 2007 petitions. A May 2026 report quotes the police chief saying the city has had no significant issues with it. A March 2021 report says the public safety committee had asked for an ordinance that parallels the new state code, and that the state code keeps these vehicles off controlled-access highways such as I-70, I-470 and W.Va. 2. County roads Open
The county's 2005 ordinance bars an ATV from any unincorporated road with a centerline or more than two lanes except to cross, and from the shoulder of one for more than ten miles at 25 mph or less to get from one trail to another. The ordinance does not reach roads inside municipalities. Why the engine decides which truck comes in.
The same three facts hold in West Virginia and every other state.
The 25 year truck
It comes in on age
A 25 year old kei truck in original configuration clears both agencies on age. No Registered Importer and no Independent Commercial Importer is needed.
EPA's provision asks only that the truck is in its original configuration with the same model of engine it left the factory with.
40 CFR 85.1511(f)(2)eCFR, read 28 October 2026The newer truck
EPA asks for a certified engine
A newer kei truck comes in as nonroad equipment, permanently modified so its top speed is 25 mph or less, with its engine covered by an EPA certificate of conformity before it reaches US Customs. The governor stays for the life of the truck, and removing it is tampering, a federal offense.
Mini-trucks, importing used motor vehicles as nonroad vehiclesEPA, read 28 October 2026Engine size
Why 30 kilowatts decides a newer truck's engine
EPA sorts nonroad gasoline engines by maximum power, not size. Every kei engine is under 1,000 cc, so an engine of 30 kW or less may certify to the small engine standards, and 30 kW is the line that decides. Today's stock kei engines are rated above it, and a speed governor does not lower an engine's maximum power.
Every kei engine family EPA has certified for mini trucks is a lower power certified configuration, between 14.46 and 29.9 kW, under part 90 or part 1054. A certified mini truck engine is that configuration, not the stock engine.

The roadCan I drive it on the road?
West Virginia lets a titled, registered and equipped mini-truck run as a street-legal special purpose vehicle, off controlled-access and federal-aid highways and for no more than 20 miles on a road with centerline markings.
- Special purpose vehicles include all-terrain vehicles, utility terrain vehicles, mini-trucks, pneumatic-tired military vehicles and full-size special purpose-built vehicles (W. Va. Code 17A-13-1(b)(1))
- Not on a controlled-access highway such as an interstate, and not where the county, municipality or Division of Natural Resources prohibits special purpose vehicles (17A-13-1(c))
- No more than 20 miles on a highway displaying centerline pavement markings (17A-13-1(d))
- Mini-trucks may not be operated as street-legal special purpose vehicles on highways constructed under a federal highways program (17A-13-1(k))
- Subject to the certificate of title provisions and registered in the same manner as motorcycles, with a plate the size of a Class G motorcycle plate (17A-13-1(e), (g) and (h))
- Equipment: headlamp, tail lamp, brake lamp, plate lamp, rear red reflector, amber front turn signals, rear amber or red turn signals, a service brake, a horn, a muffler and any federally required emission system, left and right mirrors, a windshield or eye protection, a speedometer lit for night, a passenger seat where designed for one and tires with at least 2/32 inch tread (17A-13-1(j))

A street-legal mini-truck is titled and registered by the West Virginia Division of Motor Vehicles. A mini-truck used only on the farm needs neither.

- For farm use only, keep the ownership papers. No title or registration is required for a mini-truck used exclusively for agricultural or horticultural purposes.
- For road use, title the truck with the Division of Motor Vehicles under Chapter 17A.
- Fit the equipment 17A-13-1(j) lists and register it in the same manner as a motorcycle, with proof of insurance.
- With a registration card and an insurance certificate, the owner may apply for a motorcycle trailer sticker.

LandCan I use it on a farm or private land?
A mini-truck is its own class in West Virginia. It is neither an ATV, which is 50 inches wide or less, nor a utility terrain vehicle, whose definition excludes mini trucks.
Class. Mini-truck. West Virginia's UTV definition, four or more low-pressure or nonhighway tires, designed for off-highway use and wider than 50 inches, expressly does not include mini trucks (17A-1-1).
Registration. None for farm or private land use. Registration is only for street-legal use under 17A-13-1, and nothing in that section opens an area that is not open to motor vehicle use.
On the farm
The registration and title exemptions for implements of husbandry also apply to mini-trucks, which may use the highways going from one tract of land to another, regardless of whether the land is owned by the same or different persons, within 35 miles and not on expressways (17A-3-2(a)(2)(A)).
InspectionWhat inspection or insurance applies?
Safety. A farm exempt vehicle using the highways after sunset needs Class A farm-use status and a current inspection sticker under 17C-16. No inspection rule specific to street-legal special purpose vehicles appears in 17A-13-1.
Emissions. A street-legal special purpose vehicle needs a muffler and, if a federal statute or rule requires one, an emission control system.

Insurance. A street-legal special purpose vehicle needs a valid registration card and a certificate of insurance to apply for its motorcycle trailer sticker (17A-13-1(j)(16)).

Questions
Asked about West Virginia.
Can my county close roads to it?
Yes. A county, a municipality or the Division of Natural Resources may prohibit special purpose vehicles on its highways.
Is it an ATV or a UTV in West Virginia?
No. West Virginia's UTV definition excludes mini trucks, and an ATV is 50 inches wide or less.
Upgrades
Upgrades in West Virginia.
Height and lift. For a GVWR of 10,000 lb or less front and rear bumper height must be six to thirty-one inches, one band covering a vehicle of about 3,000 lb (W. Va. Code 17C-15-48). The body to frame distance may not exceed three inches (17C-15-48).
Tires and fenders. A vehicle changed only by tires not more than two sizes beyond the maker's maximum is not subject to the modified vehicle inspection (W. Va. Code 17C-15-48). None found on fenders, mud flaps, tire protrusion, tread depth or fender trimming (17C-15 read).
Lights. Limits are one spot lamp and two each of fog, auxiliary passing and auxiliary driving lamps at set heights (W. Va. Code 17C-15-17). A roof-mounted off-road light bar must be off on any road (17C-15-17). Four front lamps may be lit at most (17C-15-25).
Modification and inspection. A vehicle altered within the bumper height and body to frame limits is operated subject to inspection and gets a modified vehicle sticker for 25 dollars (W. Va. Code 17C-15-48). A specially constructed or reconstructed vehicle must be stated on the application (17A-3-5).

Getting it there
Where West Virginia's truck comes ashore.
From the nearest port where a sailing from Japan is on record. Road miles are an estimate, the straight line times 1.2, not a routed drive.
